Advertising for medical devices

Advertising for medical devices is regulated comparatively marginally. However, general rules are all the more important.

Advertising for medical devices is only marginally regulated - especially if you are used to the level of detail in pharmaceutical advertising law. Only Art. 69 of the MedDO (Medical Devices Ordinance) lays down the basic principles: the advertising of medical devices may only contain statements that correspond to the product information (labelling and instructions for use, MedDO, Art. 16). Misleading statements, in particular regarding the intended purpose, safety and performance of a product, are prohibited. Advertising to the public for products that are used exclusively by healthcare professionals is prohibited. Expressions such as "natural", "vegan", "sugar-free", which are explicitly prohibited in the advertising of medicinal products, must be viewed from the perspective of therapeutic products in the advertising of medical devices. However, the use of these terms is not excluded in principle. It must be ensured that medical devices are used appropriately and moderately for their intended purpose (TPA, Art. 1).
